Common questions
About foreclosures & short sales in Utah.
How does foreclosure work in Utah? ▾
When a Utah home loan is secured by a trust deed, the trustee can sell the home without going to court. Under Utah Code 57-1-24, the trustee must record a notice of default and wait at least three months before giving notice of the sale.
Is there a redemption period after a Utah foreclosure sale? ▾
Not after a trustee's sale. Under Utah Code 57-1-28, the trustee's deed passes title to the buyer without a right of redemption.
What is the difference between a short sale and a foreclosure? ▾
In a short sale, the owner still owns the home and sells it for less than the loan balance with the lender's approval. A foreclosure or bank-owned (REO) home has already been taken back by the lender, which is now the seller.
How long does a short sale take in Utah? ▾
Longer than a regular sale, because the lender has to approve the price. Over the last 12 months, these listings took a median of 78 days to go under contract, against 39 days for all Utah homes.
Are foreclosures cheaper in Utah? ▾
The median asking price for these listings is $370,000 right now, against $565,000 for all Utah homes for sale. Some need work, so compare price per square foot and repair costs, not just price.
